These Terms of Service ("Terms") govern your use of the DeepCleaner: AI Clear & Boost mobile application ("the App," "DeepCleaner," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Service Description
DeepCleaner is a mobile application designed for iOS devices that provides the following features:
1.1 Photo Library Cleanup
- Duplicate Detection: Identifies and groups identical photos and videos
- Similar Photo Detection: Finds visually similar images using image hashing algorithms
- Similar Screenshot Detection: Detects screenshots with similar content
- Blur Detection: Identifies out-of-focus or blurry photos
- Screenshot Classification: Categorizes all screenshots in your library
- Favorites and Hidden Albums: Organizes favorited and hidden media
1.2 Media Compression
- Photo compression with four quality levels (low, medium, high, ultra-high)
- Video compression to reduce file sizes
- Bulk compression of multiple files
1.3 Private Vault
- Encrypted storage for photos and videos using AES encryption
- PIN code protection with SHA256 hashing
- Biometric authentication (Face ID / Touch ID)
- Import photos and videos from library or camera
1.4 Swipe Organize
- Card-based interface for quick photo sorting (swipe left to delete, right to keep)
- Monthly review of organized photos
- Saved photo list management
1.5 Charging Animations
- Custom charging animations when device is plugged in
- Battery status monitoring and display
- Siri Shortcuts integration
1.6 Widgets
- Battery status widget for home screen
- Storage usage widget
- Combined battery and storage widget
2. Subscription Terms
2.1 Subscription Plans
DeepCleaner offers two subscription tiers:
- Free Tier: Limited daily deletion quota, basic features
- Premium Subscription: Unlimited deletions, full access to all features, available as:
- Weekly subscription
- Yearly subscription
Note: Pricing is displayed in the App Store and may vary by region and currency. Current prices are shown in-app before purchase.
2.2 Billing and Renewal
- Subscriptions are billed through your Apple ID account and managed via the App Store
- Payment is charged to your Apple ID at confirmation of purchase
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- The renewal cost will match the original subscription price unless we notify you of a price change in advance
2.3 Managing Your Subscription
- You can manage and cancel subscriptions through iOS Settings > [Your Name] > Subscriptions
- Cancellation takes effect at the end of the current billing period
- No refunds are provided for unused portions of subscription periods
- If you cancel, premium features remain accessible until the subscription expires
2.4 Purchase Restoration
You can restore previous purchases on the same Apple ID by tapping "Restore Purchases" in the app's subscription screen. Purchases cannot be transferred between Apple IDs.
2.5 Free Trials (If Applicable)
If a free trial is offered, you must cancel before the trial period ends to avoid being charged. Trial availability and duration may vary and are shown in the App Store at the time of subscription.
3. User Responsibilities
3.1 Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that violates applicable laws or regulations
- Attempt to reverse engineer, decompile, or disassemble the App
- Remove or modify any copyright, trademark, or proprietary notices
- Use automated systems (bots, scripts) to interact with the App in unauthorized ways
- Interfere with or disrupt the App's servers or networks
- Attempt to gain unauthorized access to any part of the App or its systems
3.2 Account Security
- You are responsible for maintaining the confidentiality of your Private Vault PIN code
- You are responsible for all activities that occur under your Apple ID when using the App
- Notify us immediately at support@trueheart.uk if you suspect unauthorized access
3.3 Data Backup
You are solely responsible for backing up important photos and data before using the App's deletion or compression features. We recommend using iCloud Photos or another backup solution. Deleted photos go to your device's "Recently Deleted" album for 30 days before permanent removal.
4. Intellectual Property
4.1 App Ownership
The App, including its design, features, graphics, text, and software code, is owned by us and protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the App on devices associated with your Apple ID.
4.2 Your Content
You retain all rights to photos, videos, and other content you import into or process with the App. We do not claim ownership of your content. As stated in our Privacy Policy, your media files are processed locally and not uploaded to our servers.
4.3 Trademarks
"DeepCleaner," "AI Clear & Boost," and associated logos are our trademarks. You may not use these marks without our prior written permission.
5. Disclaimers
5.1 "As-Is" Service
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
5.2 Feature Accuracy
While we strive for accuracy, we do not guarantee that:
- Duplicate or similar photo detection will identify all duplicates or be free from false positives
- Blur detection algorithms will correctly classify all blurry images
- Compression will achieve specific file size reductions while maintaining desired quality
- Storage calculations are exact (estimates may vary due to iOS file system overhead)
5.3 Data Loss
We are not responsible for data loss resulting from:
- User-initiated deletions through the App
- Compression operations that reduce image or video quality beyond user expectations
- iOS system behavior (e.g., automatic deletion from "Recently Deleted" after 30 days)
- Device failures, loss, or theft
Important: Always back up important data before using cleanup or compression features.
5.4 Third-Party Services
The App integrates with third-party services (Apple StoreKit, attribution SDKs, analytics platforms). We are not responsible for the availability, accuracy, or performance of these third-party services.
6. Limitation of Liability
6.1 General Limitations
To the maximum extent permitted by applicable law, we shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Damages arising from your use or inability to use the App
- Damages resulting from deletion or loss of photos, videos, or other content
6.2 Maximum Liability
Our total liability for any claims arising from or related to these Terms or your use of the App shall not exceed the amount you paid for your subscription in the 12 months preceding the claim, or $50 USD, whichever is greater.
6.3 Exceptions
Nothing in these Terms limits our liability for:
- Death or personal injury caused by our gross negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited by applicable law
7. Termination
7.1 Termination by You
You may stop using the App at any time by:
- Deleting the App from your device
- Canceling your subscription through iOS Settings (see Section 2.3)
7.2 Termination by Us
We may suspend or terminate your access to the App if:
- You violate these Terms
- Your subscription payment fails or is reversed
- We detect fraudulent or abusive activity
- Required by law or legal process
7.3 Effect of Termination
Upon termination:
- Your right to use premium features ends immediately (or at subscription expiration if you cancel)
- Data stored locally on your device (including Private Vault content) remains accessible until you delete the App
- We may delete server-side data associated with your device identifiers in accordance with our Privacy Policy
- Sections 4 (Intellectual Property), 5 (Disclaimers), 6 (Limitation of Liability), and 8 (Governing Law) survive termination
8. Governing Law and Disputes
8.1 Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.
8.2 Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
- Informal Resolution: Contact us at support@trueheart.uk to attempt good-faith resolution
- Arbitration or Court: If informal resolution fails, disputes shall be submitted to the exclusive jurisdiction of the courts of England and Wales
8.3 Class Action Waiver
To the extent permitted by law, you agree to resolve disputes individually and waive the right to participate in class actions or class-wide arbitration.
9. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, legal requirements, or app features. Material changes will be notified through:
- In-app notice when you next open the App
- Push notification (if you have notifications enabled)
- Updated "Last Updated" date at the top of this page
Continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you should stop using the App and cancel your subscription.
10. Miscellaneous
10.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements or understandings.
10.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10.3 No Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
10.4 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms to any affiliate or successor without restriction.
10.5 Apple Terms
These Terms are between you and us, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide support for the App. In the event of any third-party claim that the App infringes intellectual property rights, we (not Apple) are responsible for investigation and defense of such claims.
11. Contact Us
Important Reminder: Before using the App's deletion or compression features, please ensure you have backed up important photos and videos using iCloud Photos or another backup solution. We are not responsible for data loss resulting from user-initiated actions.
